This website (“88daysofficial.com”) is operated by 88Days LLC (“88Days,” “we,” “us,” or “our”). By accessing the Site, creating an account, purchasing products (including subscription products), or otherwise using any services made available through the Site (collectively, the “Service”), you agree to these Terms of Service (“Terms”) and the policies referenced here, including our Privacy Policy, Shipping Policy, and Return/Refund Policy (collectively, the “Policies”). If you do not agree, do not use the Site.

We may update these Terms at any time by posting a revised version on the Site. The “Last Updated” date indicates the most recent revision. Continued use after changes are posted constitutes acceptance of the revised Terms.

Our store may be hosted by an ecommerce platform (including Shopify) and we use third-party providers for payments, subscriptions, shipping, analytics, and related services.

If you access the Site or purchase from outside the United States, you acknowledge that additional consumer protection laws may apply in your jurisdiction, and nothing in these Terms limits any non-waivable rights you may have under those laws.

You must be at least the age of majority where you live and have legal capacity to enter into this Agreement. You agree to use the Site in compliance with all applicable laws.

If you create an account, you agree to provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms or applicable Policies

We may refuse service, cancel orders, limit quantities, or restrict access to the Site where permitted by law, including to prevent fraud, abuse, policy violations, or unauthorized resale activity.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.

We may correct errors and update information at any time, including after an order is submitted. If a material error affects your order, we may cancel the order and issue a refund.

Product images and colors may appear different due to device settings, lighting, and production variation.

Prices are shown in USD unless stated otherwise. Prices and promotions may change at any time.

We aim to present the total price you will pay at checkout, including any mandatory fees (other than government taxes/fees and carrier shipping charges) consistent with California price transparency requirements. Shipping, taxes, and other charges will be shown during checkout before you submit payment.

By placing an order, you authorize us (and our payment processors) to charge your selected payment method for the total amount shown at checkout (including taxes and shipping).

We may, as permitted by law, limit or cancel quantities purchased per person, per household, or per order, including orders that appear to be placed by dealers/resellers. If we cancel an order after payment, we will refund to the original payment method.

You agree to provide current, complete, and accurate purchase and account information and to promptly update information (including email address and payment details) to allow us to complete transactions and contact you as needed.

Shipping terms, delivery estimates, and related issues are addressed in our Shipping Policy. Delivery dates are estimates and not guaranteed. Carrier delays and events outside our control may affect delivery times.

Returns, refunds, and exchanges are governed by our Return/Refund Policy. If there is any conflict between these Terms and the Return/Refund Policy, the Return/Refund Policy controls for return/refund matters.

This section applies to any products sold on an automatic renewal or subscription basis (“Subscription”).

10.1 Subscription Terms Disclosed at Checkout

Before you complete a Subscription purchase, we will present the material Subscription terms clearly and conspicuously, including (as applicable):

- That the Subscription automatically renews unless canceled

- The recurring charge amount and frequency

- Whether pricing is promotional and when it changes

- How to cancel and any cancellation deadlines

- Any other material terms required by applicable law

By completing a Subscription purchase, you provide affirmative consent to the automatic renewal terms and recurring charges.

10.2 Authorization to Charge

You authorize 88Days to charge your selected payment method on a recurring basis at the cadence and amount disclosed at checkout, plus applicable taxes and shipping (if applicable), until you cancel.

If your payment method cannot be charged, we may retry the charge, notify you, and/or pause or cancel your Subscription consistent with the subscription terms disclosed at checkout.

10.3 Acknowledgment and Retainable Confirmation

After purchase, you will receive a confirmation (e.g., email) containing the Subscription terms and instructions for cancellation that you can retain.

10.4 Cancellation (“Easy to Cancel”)

You may cancel your Subscription using the method provided at checkout and in your confirmation (typically via your account portal or a cancellation link). Cancellation will take effect as described at checkout and in the Subscription terms.

10.5 Changes to Subscription Terms

If we make material changes to your Subscription (where required), we will provide notice and obtain consent as required by applicable law.

Our products are intended for external use only unless explicitly stated otherwise. Always read labels and directions before use. Consider patch testing prior to full use. Stop use if irritation occurs.

Information on the Site is for general informational purposes and is not medical advice. Consult a qualified professional for medical concerns.

If you submit reviews, photos, feedback, ideas, suggestions, or other content (“User Content”), you represent that:

- You own or have the rights to submit the User Content; and

- The User Content does not violate law or third-party rights.

You grant 88Days a non-exclusive, worldwide, royalty-free, perpetual, sublicensable license to use, reproduce, modify, publish, distribute, and display your User Content for business purposes (including marketing), unless prohibited by law. We may remove User Content at our discretion.

All Site content (including trademarks, logos, product names, designs, text, photos, graphics, and layout) is owned by 88Days or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written permission.

You agree not to:

- Use the Site for unlawful, fraudulent, or abusive purposes

- Attempt to access systems/accounts without authorization

- Scrape, crawl, or use automated means to harvest Site data without permission

- Transmit malware or harmful code

- Interfere with Site security or functionality

- Infringe intellectual property rights or misrepresent affiliation with 88Days

We may suspend or terminate access for violations.

The Site may include third-party links or integrate third-party services (payments, subscriptions, shipping, analytics). We do not control third-party services and are not responsible for their content, practices, or availability. Your use of third-party services is at your own risk and subject to their terms.

Certain warranty disclaimers are limited by California law, including for consumer goods. To the extent required by law, implied warranties (including merchantability and fitness) may apply and cannot be disclaimed in certain circumstances. Any express warranty we provide will be stated where applicable.

TO THE FULLEST EXTENT PERMITTED BY LAW, 88DAYS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST REVENUE, OR LOSS OF DATA) ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR PRODUCTS.

TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, 88DAYS’ TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO 88DAYS FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE 90 DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR THE MINIMUM AMOUNT REQUIRED BY LAW, WHICHEVER IS GREATER.

Some limitations may not apply to you depending on the nature of the claim and applicable law.

You agree to indemnify and hold harmless 88Days and its owners, officers, employees, affiliates, agents, and service providers from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the Site or products, or your violation of law or third-party rights.

These Terms remain effective unless terminated by you or us. You may stop using the Site at any time. We may suspend or terminate access if we believe you violated these Terms or Policies. Provisions that should survive termination will survive (including intellectual property, disclaimers, liability limits, indemnity, and governing law).

If any provision is held unlawful or unenforceable, the remaining provisions remain in full force and effect.

These Terms and the Policies constitute the entire agreement between you and 88Days relating to your use of the Site and purchases, superseding prior agreements and communications.

These Terms are governed by the laws of theState of California, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms, the Site, or products must be brought in the state or federal courts located inLos Angeles County, California, unless a different venue is required by applicable law.
